Nutzungsbedingungen

1. Die Allgemeinen Geschäftsbedingungen der screen art® productions gmbh in der jeweils aktuellen Fassung gelten für die Abwicklung sämtlicher Aufträge der Firma im Bereich Produktion, Dienstleistung/Kamera und Schnittplatzvermietung. Diese Bedingungen sind Teil des jeweiligen Auftrages. Der Hauptvertrag kommt zustande, nach Bestelleingang bei screen art® und nach Prüfung durch screen art®. Abweichende Bedingungen auf Käuferseite werden nur dann wirksam, wenn sie im Einzelfall schriftlich anerkannt werden.

2. Bis 24 Stunden (an Werktagen) vor Dreh- oder Schnittbeginn kann der Auftrag kostenfrei storniert werden. Bei mehrtägigen Produktionen verdoppelt sich die Frist. Für Auftragsproduktionen wird eine volle Abrechnung der bis zum Zeitpunkt einer möglichen Stornierung angefallenen Arbeiten sowie ein 30%iger Abschlag auf die verbleibende Vertragssumme fällig.

3. Bis zum Zeitpunkt der vollständigen Bezahlung der Rechnung einschließlich aller Nebenkosten bleiben die Nutzungsrechte der Materialien und die Ware selbst im Besitz von screen art®.

4. Für alle Ansichtskopien für Mitwirkende oder anders Beteiligte an Auftragsproduktionen, die screen art® für Fernsehsender oder andere Verwerter erstellt hat, gilt ausschließlich das Recht, die Medien im rein privaten Bereich zu nutzen. Ohne ausdrückliche Zustimmung sind insbesondere untersagt: -jede öffentliche Vorführung; -Vervielfältigung und Überspielung auf technische Weise; Bei Verstößen behalten wir uns Geltendmachung von Schadensersatz und strafrechtliche Verfolgung vor oder treten diese Rechte an unsere Auftraggeber ab.

5. Offensichtliche Mängel müssen innerhalb von acht Werktagen nach Empfang der Ware schriftlich angezeigt werden. Für die Anzeige nicht offensichtlicher Mängel gelten die gesetzlichen Vorschriften. Inhaltliche und gestalterische Änderungen nach erfolgter Abnahme sind kostenpflichtig. Wir haften nur für vollständigen Lieferumfang entsprechend unserer Angaben und die einwandfreie Bild- und Tonqualität im Rahmen anerkannter Regeln der Technik. Eine eingeschränkte Lauffähigkeit aufgrund von systembedingten Gegebenheiten und Eigenarten eines Programms sind nach der Rechtsprechung kein Fehler des Programms. Screen art® übernimmt hierfür keine Haftung.

6. Die Haftung beschränkt sich zunächst nach unserer Wahl auf kostenlose Reparatur/ Neubespielung oder Lieferung einwandfreier Stücke.

7. Gerichtsstand für alle sich ergebenden Ansprüche ist – soweit nach Zivilprozessordnung zulässig – Frankfurt. Erfüllungsort ist Frankfurt.

Anzuwenden ist ausschließlich das Recht der Bundesrepublik Deutschland.

Terms and Conditions

1. The General Terms and Conditions of screen art® productions gmbh as amended apply for all orders handled by the company in the fields of production, service/camera and editing suite leasing. These business terms are a constituent part of the respective order. The main contract will come about upon receipt of the purchase order by screen art® and verification by screen art®. Conflicting conditions of the buyer will only be effective if they are recognised in writing in the individual case.

2. The order may be cancelled at no cost up to 24 hours Mo-Fri and Friday before Sunday, before the start of filming or editing. This period will double in the case of productions lasting more than one day. For one-off productions, the work performed until the time of any cancellation will be charged in full and 30% of the remaining contract sum will be payable.

3. Rights of use to the materials and goods themselves will remain with screen art® until such time as the invoice, including all ancillary costs, has been settled in full.

4. All approval copies for collaborators or other participants in one-off productions that screen art® has created for television stations or other exploiters are provided solely for private use. In particular, the media may not be presented in any public performance, duplicated or transferred in any technical form without express permission. In the event of infringement, we reserve the right to assert claims for damages and initiate prosecution or assign these rights to our customer.

5. Obvious defects must be notified in writing within eight working days of receipt of the goods. Non-obvious defects must be notified in accordance with statutory regulations. Changes to content and design after acceptance will be subject to a fee. We will only be liable for the complete scope of supply in accordance with our information and for perfect picture and sound quality within the scope of the recognised rules of the art. Court rulings have indicated that restricted compatibility due to local system conditions and peculiarities of a program do not constitute a defect in the program. Screen art® does not accept any liability for this.

6. Liability will in the first instance be restricted at our option to free repair / re-recording or the supply of perfect goods.

7. The place of jurisdiction for all disputes that may arise will – where permitted by the Code of Civil Procedure – be Frankfurt. The place of performance is Frankfurt.

The laws of the Federal Republic of Germany alone will apply.
